1. About Us
This website, emilewines.co.uk, is operated by Emile Wines Ltd ("Emile Wines", "we", "us" or "our").
Emile Wines LtdRegistered company number: 12550499
Registered office: 71–75 Shelton Street London WC2H 9JQ, GBR.
VAT registration number: 346944271
General enquiries: orders@emilewines.co.uk
Club Emile enquiries: clubemile@emilewines.co.uk
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
2. Age Restrictions
You must be at least 18 years old to purchase alcohol from Emile Wines.
By placing an order, you confirm that you are aged 18 or over.
We operate an age-verification policy and may request proof of age before accepting an order or at the point of delivery.
Our delivery partners may refuse to hand over alcohol if satisfactory proof of age cannot be provided.
Alcohol must not be purchased on behalf of anyone under the age of 18.
We reserve the right to refuse or cancel an order where we cannot verify the customer's age or reasonably believe that the purchase would breach applicable alcohol licensing laws.
3. Club Emile Subscriptions
Club Emile is a wine subscription service offering selections of wines from independent growers chosen by Emile Wines.
Customers can select from the subscription options available on our website, choosing their preferred number of bottles and delivery frequency.
The price, bottle quantity and delivery frequency for each subscription are displayed at checkout and confirmed in your order confirmation.
Each selection is curated by Emile Wines and may include information about the wines and their producers.
Selections are not individually tailored to personal tastes unless expressly agreed otherwise.
Automatic Renewals
Club Emile subscriptions automatically renew according to the delivery frequency selected at checkout.
By subscribing, you authorise our payment provider to charge your chosen payment method automatically for each renewal until your subscription is paused or cancelled.
Your first payment is taken when you subscribe. Subsequent payments are normally taken on the corresponding date of each subscription period.
Your subscription price and payment frequency will be confirmed when you subscribe and will be available through your online account.
We will provide renewal reminders, subscription information and cooling-off notices where required by applicable law.
Dispatch of Subscription Boxes
Once your subscription payment has been successfully processed, we will prepare and dispatch your wine selection as soon as reasonably possible.
We do not guarantee dispatch on the same day as payment.
Delivery times may vary depending on warehouse schedules, stock availability, weekends and bank holidays.
Subscription Price Changes
If we need to change the price of your subscription, we will give you at least 30 days' notice by email before the new price takes effect.
You may cancel your subscription before the new price applies.
We will not apply a price increase retrospectively to a selection already paid for.
4. Managing, Pausing and Cancelling Your Subscription
You may manage your Club Emile subscription at any time by logging into your online account at emilewines.co.uk.
Alternatively, you can email clubemile@emilewines.co.uk and we will assist you.
You can:
-
Pause your subscription.
-
Skip an upcoming selection.
-
Change your subscription frequency or bottle quantity.
-
Update your delivery or payment details.
-
Cancel future subscription renewals.
There is no fee for cancelling your subscription.
To avoid your next scheduled payment, please cancel or make changes before that payment is processed.
Where payment has already been taken, cancellation of future renewals does not automatically cancel the order already paid for. Any statutory cancellation or cooling-off rights applicable to that order remain unaffected.
We will confirm your cancellation and explain when it takes effect.
Paused Subscriptions
While your subscription is paused, you will not receive selections or be charged for them.
Your subscription will resume on the date selected through your account or agreed with us.
The Club Emile subscriber discount is not available while your subscription is paused.
Ending a Subscription
We may suspend or cancel a subscription if payment repeatedly fails, if we cannot verify the customer's age, or if there are reasonable grounds to believe these terms have been breached.
If we discontinue Club Emile, we will give subscribers reasonable notice and refund any payments for selections that will not be supplied.
Your statutory rights remain unaffected.
5. Club Emile Subscriber Discount
Active Club Emile subscribers receive 15% off wines purchased directly from our portfolio.
This discount applies to all wines in our portfolio, subject to availability.
Portfolio wines can be ordered by emailing clubemile@emilewines.co.uk.
The discount is available only while a recurring Club Emile subscription is active.
It does not apply:
-
While a subscription is paused.
-
After a subscription has been cancelled.
-
To one-off Club Emile selections.
-
In combination with other promotional offers, unless expressly agreed by us.
The subscriber discount applies to portfolio wine purchases and does not automatically apply to other products or services sold through our website.
6. One-Off Purchases, Portfolio Orders and Order Restrictions
In addition to Club Emile subscriptions, customers may purchase one-off wine selections and other products available on our website.
One-off purchases do not automatically renew or create a recurring subscription.
Portfolio Wine Purchases
Customers may also purchase wines directly from our portfolio, whether or not they are Club Emile subscribers.
Portfolio wines are ordered by emailing clubemile@emilewines.co.uk.
There is no minimum order quantity for portfolio purchases.
Once an order has been confirmed, we will issue an invoice by email.
Payment must be made by bank transfer in accordance with the instructions shown on the invoice.
Invoices are payable within three working days of the invoice date unless otherwise agreed.
We will not dispatch portfolio wine orders until payment has been received in cleared funds.
Prices and availability are held for three working days from the invoice date. If payment is not received within this period, we may contact you to cancel the order and release the stock.
Any payments already received for an order we cancel will be refunded.
Prices and Availability
All consumer prices are quoted in pounds sterling and include applicable VAT and alcohol duty unless expressly stated otherwise.
Any applicable delivery charges will be displayed or confirmed before you commit to an order.
Our wines are sourced from independent growers, often producing in small quantities, and availability may be limited.
We reserve the right to correct genuine pricing or product-description errors. If an error affects an order already placed, we will contact you to agree how to proceed or cancel the order and provide a full refund.
We will not increase the agreed price of an order after acceptance without your agreement.
Order Acceptance and Restrictions
All orders are subject to availability and acceptance by Emile Wines.
We reserve the right to refuse an order or limit quantities where reasonably necessary, including where stock is limited, an obvious pricing error has occurred, age verification cannot be completed, or we reasonably suspect fraudulent purchasing.
Certain wines may be subject to individual purchase limits due to limited availability.
If we are unable to accept or fulfil your order, we will notify you and refund any payment received for goods we cannot supply.
We may discontinue products or change the wines available for future purchases at any time. This will not affect orders we have already accepted, except as permitted by law.
Trade and Wholesale Purchases
Our website, Club Emile subscriptions and direct portfolio purchases are intended for private customers.
If you are purchasing wine for a restaurant, wine bar, shop or other business, we'd be delighted to discuss our wholesale offering with you.
Please contact us at orders@emilewines.co.uk to discuss opening a trade account, our wholesale pricing and trade terms.
Trade customers should contact us directly rather than placing orders through our consumer website.
7. Delivery
We offer standard delivery to mainland UK addresses.
Delivery Charges
Club Emile subscriptions
Standard mainland UK delivery is included free of charge.
Portfolio purchases and other eligible one-off orders
-
Orders over £75 qualify for free standard mainland UK delivery.
-
Orders of £75 or less incur a £7 standard delivery charge.
Delivery to Northern Ireland, the Scottish islands and other destinations outside our standard mainland UK delivery area may be available by prior arrangement.
Please contact us before ordering so we can confirm availability and provide a delivery quotation.
Dispatch and Delivery Times
Orders are normally dispatched Monday to Friday, excluding bank holidays.
Subscription boxes are dispatched as soon as reasonably possible following successful payment.
Portfolio orders are dispatched following receipt of cleared payment.
Any delivery dates or estimated arrival times provided are estimates and not guaranteed.
We will deliver within the timeframe agreed with you or, where no specific timeframe has been agreed, within the period required by applicable consumer law.
If a delivery is significantly delayed, please contact us so we can investigate and arrange an appropriate resolution.
Receiving Your Delivery
As our products contain alcohol, someone aged 18 or over must be available to accept delivery.
Our delivery partners may request proof of age and refuse delivery where satisfactory identification cannot be provided.
Please ensure your delivery address is correct and notify us as soon as possible if you need to make changes.
We cannot guarantee that delivery details can be amended once an order has been dispatched.
Unsuccessful Deliveries
If a delivery cannot be completed because nobody aged 18 or over is available to receive it, satisfactory proof of age cannot be provided, or the delivery information supplied is incorrect, the parcel may be returned to our warehouse.
We will contact you to arrange redelivery. Where the unsuccessful delivery was caused by circumstances within your control, we may charge the reasonable additional delivery and return costs incurred.
If you choose not to arrange redelivery, we will explain the available options, including any applicable cancellation and refund rights.
Where permitted by law, reasonable costs arising from an unsuccessful delivery may be deducted from any refund, provided the charges are appropriate and have been disclosed.
Nothing in this section affects your statutory rights, including where the delivery failure was caused by us or our delivery partner.
Responsibility for Deliveries
We remain responsible for your order until it has been delivered into your physical possession or that of a person you have nominated to receive it, subject to applicable law.
If an order is lost or damaged in transit, please contact us directly. We will investigate and arrange an appropriate replacement or refund.
8. Wine Availability, Substitutions and Descriptions
Our wines are sourced from independent growers and may be available only in limited quantities.
The wines included in Club Emile selections may vary between deliveries.
Wine Substitutions
If a wine intended for a Club Emile selection becomes unavailable, we may substitute it with another wine of equal or greater value and, wherever possible, a similar style.
We will inform you of any substitutions.
If a substitution materially changes the goods you agreed to purchase, your statutory rights remain unaffected.
For individual portfolio purchases, we will not substitute an unavailable wine without your agreement.
If we cannot fulfil an order, we will contact you to discuss an alternative or arrange an appropriate refund.
Wine Descriptions and Natural Variation
We take care to provide accurate descriptions of our wines, including producers, vintages and tasting notes.
Tasting notes and food-pairing suggestions are provided as guidance, and individual perceptions of a wine's character may vary.
As wines are natural products, some variation between bottles may occur. Such variation does not automatically indicate a fault.
Nothing in this section affects your statutory rights where a wine is faulty or not as described.
9. Returns, Cancellations and Refunds
Your Statutory Cancellation Rights
When purchasing wine online or by email as a consumer, you may have a statutory right to cancel your purchase without giving a reason.
For eligible one-off distance purchases, the cancellation period normally ends 14 days after you, or someone you nominate, receives the goods.
Different statutory cancellation and cooling-off provisions may apply to Club Emile subscriptions, including initial subscription periods and qualifying renewals.
We will honour the cancellation and cooling-off rights applicable to your purchase under the law in force at the relevant time.
To exercise a statutory cancellation right, please notify us clearly by emailing clubemile@emilewines.co.uk within the applicable cancellation period.
Cancelling a recurring subscription to stop future payments is separate from exercising a statutory right to cancel an order or subscription during an applicable cooling-off period.
Returning Wine Because You Have Changed Your Mind
Where you exercise a statutory right to cancel a purchase because you have changed your mind, you must return the wine within the applicable legal timeframe, normally within 14 days of notifying us of cancellation for eligible one-off purchases.
You are responsible for the direct cost of returning the wine, where permitted by law and provided we have informed you of this responsibility before purchase.
You may arrange a suitable return yourself or request a collection through our warehouse.
Warehouse collections must be arranged in advance and are subject to an agreed collection date and a three-hour collection window.
Collection charges vary depending on the order and collection location. We will confirm the cost before arranging collection.
Any collection charge must be agreed with you in advance.
Please package returned wine securely to minimise the risk of damage in transit.
You should take reasonable care of the wine while it is in your possession.
Where permitted by law, we may make a deduction from your refund if the goods have diminished in value because they have been handled beyond what would reasonably be necessary to inspect them.
Refunds
Where you are entitled to a refund following a statutory cancellation, we will refund the amount required by law.
For eligible one-off purchases, this includes the original standard delivery charge where applicable. Additional charges for premium delivery options are not normally refundable beyond the standard delivery cost.
Refunds will be processed within the applicable statutory timeframe.
For eligible one-off goods purchases, we may withhold a refund until we have received the returned goods or evidence that they have been sent back, where permitted by law.
Refunds will normally be made using the original payment method unless otherwise agreed.
Returns Outside the Statutory Cancellation Period
We do not generally accept returns of wine simply because a customer has changed their mind once the applicable statutory cancellation period has expired.
This does not affect your statutory rights where wine is faulty, damaged or not as described.
10. Faulty, Damaged or Out-of-Condition Wine
We take care in selecting, storing and delivering our wines.
If a bottle arrives damaged, leaking or appears faulty, including wine that is corked, oxidised or otherwise out of condition, please contact us as soon as possible at clubemile@emilewines.co.uk.
Please provide your order number and, where possible, photographs of the bottle, label and packaging.
We may request that you retain or return the remaining wine and bottle for assessment.
Where a return is necessary, we will explain the process and cover reasonable return costs where required by law.
Where wine is faulty or does not meet your statutory rights, we will provide an appropriate remedy, which may include a replacement or refund.
A wine that is simply not to your personal taste is not necessarily faulty, although we welcome customer feedback.
Nothing in these terms affects your rights under the Consumer Rights Act 2015.
11. Payment and Account Information
You agree to provide accurate and up-to-date information when placing an order or managing a subscription.
This includes your name, email address, billing and delivery details, and payment information.
Subscription payments are processed securely through our payment provider.
We do not store your full payment card details.
If a recurring subscription payment fails, we may attempt to collect payment again and will contact you where necessary.
If payment cannot be collected, we may pause or cancel your subscription.
You will not be charged for future selections after a cancellation has taken effect, although you remain responsible for any valid outstanding payments relating to orders already placed, subject to your statutory rights.
12. Privacy and Personal Information
We collect and process personal information as necessary to manage orders, subscriptions, payments, deliveries and customer enquiries.
Personal information is handled in accordance with applicable UK data protection legislation.
Our payment providers, e-commerce platform and delivery partners may process relevant information to enable us to provide our services.
Further information about how we collect, use, store and protect personal information, including your rights and how to exercise them, is available in our Privacy Policy on emilewines.co.uk.
Marketing communications will be sent in accordance with applicable law, and you may opt out of marketing at any time.
13. Website Use and Intellectual Property
All content on emilewines.co.uk, including text, photographs, branding and other materials, belongs to Emile Wines or the relevant rights holders unless otherwise stated.
You may not reproduce, distribute or commercially exploit our website content without permission.
You must not use our website for unlawful purposes, attempt to interfere with its security or functionality, or provide false or misleading information.
You must not submit or transmit unlawful, abusive, defamatory, fraudulent or malicious content, or use our website to infringe another person's intellectual property or privacy rights.
Where our website permits customer reviews or other public submissions, we may remove content that is unlawful, misleading, abusive or otherwise breaches these terms.
Our website may contain links to third-party websites. We are not responsible for the content or privacy practices of those websites, subject to applicable law.
14. Website Availability, Liability and Your Legal Rights
We aim to ensure that our website and services are available, accurate and reliable. However, we cannot guarantee that access to our website will always be uninterrupted, secure or free from technical errors.
We may occasionally suspend access to our website for maintenance, updates or circumstances beyond our reasonable control.
While we make every effort to ensure that information on our website is accurate and up to date, occasional errors may occur. If an error affects an order you have placed, we will contact you to agree an appropriate resolution.
We are responsible for supplying goods that meet your statutory rights and for fulfilling our obligations under these Terms & Conditions.
We are responsible for foreseeable losses caused by our breach of these terms or our failure to exercise reasonable care and skill, subject to applicable law.
We are not responsible for losses that were not reasonably foreseeable, except where the law requires otherwise.
Our products are intended for personal use. To the extent permitted by law, we are not responsible for business losses, including loss of profits, revenue or business opportunities, arising from consumer purchases.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded or limited.
Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.
Responsible Drinking
Please drink responsibly. Our products contain alcohol and must not be purchased by or supplied to anyone under 18.
We recommend drinking in moderation and following current UK health guidance on alcohol consumption, including advice concerning pregnancy.
15. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal obligations.
The latest version will be available on emilewines.co.uk.
For active Club Emile subscribers, we will notify you of material changes affecting your subscription before they take effect, where required by law.
Changes will not retrospectively remove rights that you have already acquired.
If you do not wish to continue your subscription following a material change, you may cancel future renewals through your online account or by contacting us.
16. Governing Law and General Provisions
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory legal protections applicable to you and any rights to bring proceedings in the courts of your home jurisdiction.
Severability
If any provision of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
Outstanding Obligations
Cancelling a subscription or ceasing to use our website does not remove any valid payment obligations or liabilities arising before cancellation took effect.
Nothing in this section affects your statutory cancellation and refund rights.
Our Agreement With You
These Terms & Conditions, together with the details confirmed at checkout or in your order confirmation and any additional terms expressly agreed with you, form the agreement between you and Emile Wines for your purchase or subscription.
Nothing in these terms excludes your statutory rights or prevents you from relying on information or representations that the law requires us to honour.
